Terms of Service

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("Operator" or "User") and DoNotRent.com. By registering for an account, accessing, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy.

2. Description of Service

DoNotRent.com is a subscription-based platform that allows verified independent vehicle rental operators to submit, search, and access operator-submitted incident reports about renters. The Platform is intended solely as an informational tool for legitimate vehicle rental businesses.

The Platform is not a consumer reporting agency as defined under the Fair Credit Reporting Act (FCRA), and is not intended for use in employment screening, tenant screening, credit evaluation, or any other regulated consumer eligibility determination.

3. Eligibility and Account Registration

• Be at least 18 years of age
• Operate a legitimate vehicle rental business
• Provide accurate, complete, and current registration information
• Maintain confidentiality of account credentials

“Verified Operator” refers solely to a business identity verification process used to confirm that an account is associated with a legitimate vehicle rental business. Verification does not constitute approval of, endorsement of, or validation of any content submitted by the Operator.

4. Subscription Plans and Payment

• Free (Contributor): submit reports only
• Operator ($15/month): full search access plus report submission
• Fleet ($30/month): full search access, report submission, and API access

Subscriptions are billed monthly in advance. Payment processing is handled by Stripe and subject to Stripe terms.

5. Operator Obligations and Conduct

• Submit only truthful, accurate, good-faith reports based on direct experience
• Keep documentation or a factual basis supporting submitted reports
• Do not submit discriminatory, retaliatory, false, or fabricated reports
• Comply with all applicable federal, state, and local laws
• Do not use the Platform for employment screening, tenant screening, credit evaluation, or any regulated consumer reporting purpose

6. Content Review and Reports

By submitting a report, you represent that it is accurate to the best of your knowledge and that you are authorized to submit it. You grant DoNotRent.com a non-exclusive, worldwide, royalty-free license to store and display submitted reports to verified subscribers for platform functionality.

DoNotRent.com performs a limited, administrative review of submitted reports prior to publication. This review is solely to confirm that submissions meet technical and policy requirements, including required fields, formatting, and required supporting documentation, if applicable.

DoNotRent.com does not investigate, verify, validate, or determine the truthfulness, accuracy, or completeness of any report or supporting materials submitted by Operators. Approval of a report indicates only that it met submission requirements and does not constitute endorsement, verification, or adoption of the content.

Approval of an Operator account or submission does not imply verification or approval of any content submitted by that Operator.

DoNotRent.com does not create, edit, rewrite, or materially alter Operator-submitted reports. All reports reflect solely the statements and allegations of the submitting Operator.

We reserve the right to reject, remove, restrict access to, or annotate any report that fails to meet submission requirements, violates these Terms, or presents a clear risk of misuse of the Platform. Reports may also be marked as disputed where applicable.

DoNotRent.com has no obligation to investigate, verify, or correct any report beyond its administrative review process.

Under 47 U.S.C. § 230, DoNotRent.com is an interactive computer service and does not act as the publisher or speaker of user-generated content.

7. Dispute Process

Individuals may dispute reports they believe are inaccurate or improperly submitted. We may request supporting documentation and may annotate, restrict, or remove reports where they violate Platform policies or fail to meet submission requirements.

8. Prohibited Uses

• No discrimination, retaliation, or harassment
• No scraping, reverse engineering, or unauthorized access attempts
• No account sharing or unlawful use of the Platform

9. Indemnification

You agree to indemnify and hold harmless DoNotRent.com and its affiliates from claims, damages, and expenses arising from your use, submitted reports, or legal violations.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED THE GREATER OF (A) FEES PAID IN THE PRECEDING 12 MONTHS OR (B) $100.

12. Governing Law and Dispute Resolution

These Terms are governed by Florida law. Disputes are resolved by binding arbitration in Hillsborough County, Florida, except where equitable relief is sought.

YOU WAIVE RIGHTS TO JURY TRIAL AND CLASS ACTION PARTICIPATION.

13. Modifications to Terms

We may modify these Terms at any time. Continued use after changes become effective constitutes acceptance.

14. Termination

We may suspend or terminate access at any time. Surviving sections include content rights, indemnity, disclaimers, limitations, and dispute resolution.

15. Miscellaneous

These Terms and Privacy Policy are the full agreement regarding Platform use. If any provision is unenforceable, remaining provisions remain in effect.
